Injured in Breckenridge? You Have Options
An accident in the mountains leaves you dealing with things people in Denver never think about. The nearest hospital is in another town. The other driver may live three states away. Your car is at a tow yard off Highway 9 and you are not sure how you are getting home.

Where Accidents Happen in Breckenridge
Highway 9 Through Town
Colorado Highway 9 is the only way in and out of Breckenridge from the north, and it becomes Park Avenue and Main Street as it runs through town. Everything funnels through it: skiers heading to the gondola lots, delivery trucks, buses, and people crossing on foot between businesses. Traffic slows and stacks up in ways drivers unfamiliar with the town do not expect, and rear-end collisions on that stretch are common.
Swan Mountain Road and the Route Toward I-70
Most people reach Breckenridge by taking I-70 to Exit 203 at Frisco and driving south on Highway 9 for about eight miles. Others cut across on Swan Mountain Road, a narrow route with tight curves, steep grade, and limited sight distance. In winter it stays icy in shaded sections long after the main highway has cleared.
Hoosier Pass and Winter Conditions
South of town, Highway 9 climbs Hoosier Pass at over 11,500 feet. Conditions there change fast, and vehicles that handled the drive up often cannot handle the drive down. Crashes on the pass frequently involve out-of-state drivers who have never driven a mountain descent in snow.
Injury Cases We Handle for Breckenridge Clients
Car and Truck Accidents
Rear-end collisions on Highway 9, crashes in parking structures and lots, and multi-vehicle wrecks on icy stretches. When a commercial truck or delivery vehicle is involved, the trucking company’s insurer usually has an adjuster working the claim within hours.
Pedestrian and Bicycle Accidents
Breckenridge is a walking town. People cross Main Street carrying gear, in low light, in snow, often in an unfamiliar place. Pedestrians struck by vehicles tend to suffer serious injuries even at low speeds.
Drunk Driving Crashes
Breckenridge has a dense concentration of bars and restaurants within walking and driving distance of lodging. Late-night crashes involving impaired drivers are a recurring problem here. A criminal DUI case against the other driver does not compensate you. That requires a separate civil claim.
Injuries at Hotels, Rentals, and Businesses
Icy walkways that were never cleared, unlit stairs at a short-term rental, a loading area that was not maintained. Property owners in Colorado have legal duties to people they invite onto their property, and those duties do not disappear because it snowed.
Injured While Visiting Breckenridge?
If you were hurt here and have since gone home, you can still bring a claim in Colorado. You do not have to be a Colorado resident, and you do not have to come back for every step of the process.
A few things matter more than usual in this situation. Get a copy of the Colorado crash report before you leave if you can. Keep the name of the clinic or hospital that treated you here, because those records live in Colorado and are separate from anything your doctor at home creates. And be careful about giving a recorded statement to the other driver’s insurer before you know how badly you are hurt.
Wade handles these cases regularly and works with out-of-state clients by phone and video.
Where Your Breckenridge Case Will Be Heard
Summit County cases are filed at the Summit County Justice Center, 501 N. Park Avenue, Breckenridge, CO 80424, which is part of Colorado’s Fifth Judicial District. The Fifth District also covers Eagle, Lake, and Clear Creek counties.
Most personal injury claims settle without a trial. But the court where a case would be filed still matters, because insurance companies evaluate claims differently depending on where they would have to defend them.
Getting Treated After an Accident in Breckenridge
There is no hospital inside Breckenridge. The nearest is St. Anthony Summit Hospital in Frisco, a Level III trauma center and the mountain base of operations for Flight For Life Colorado. There are also emergency mountain clinics at the base areas of Breckenridge, Copper Mountain, and Keystone.
Two things to know. First, get evaluated even if you feel like you can walk it off. Adrenaline and cold both mask injuries, and a gap between the accident and your first medical visit is the single most common argument insurers use to reduce a claim.
Second, keep every record. If you were treated at a base-area clinic and then again at home, those are two separate sets of records, and both matter.
Colorado Law That Affects Your Claim
How Long You Have to File
In Colorado, injury claims arising from the use or operation of a motor vehicle generally must be filed within three years of the accident (C.R.S. 13-80-101(1)(n)). Most other injury claims, including slip and falls and premises cases, must be filed within two years (C.R.S. 13-80-102).
Claims against a government entity have a much shorter notice deadline. If a city, county, or state vehicle or property was involved, talk to an attorney quickly.
What Happens If You Were Partly at Fault
Colorado uses modified comparative negligence with a 50 percent bar (C.R.S. 13-21-111). If you are found partly responsible, your recovery is reduced by your share of fault. If you are found 50 percent or more responsible, you recover nothing.
This is exactly why insurers push the idea that you were speeding, distracted, or driving on bad tires. In a winter crash, that argument comes up almost every time.
Colorado's Traction Law and Winter Crashes
From September 1 through May 31, Colorado’s Traction Law is in effect on I-70 between Dotsero and Morrison, and CDOT can activate it on any state highway when conditions require. It requires tires with at least 3/16-inch tread that are winter, all-weather, or mud-and-snow rated, or chains or an approved traction device.
This matters for your claim. If the other driver was not in compliance, that is evidence of negligence. If you were not, expect their insurer to raise it. Neither fact decides the case by itself.
Why Clients in Breckenridge Call Wade Zobel
Wade Zobel handles his own cases. When you call, you are not routed through a screening department and handed off to a case manager you never chose.
He is also fully bilingual and represents clients in Spanish himself, which matters in a county where a large share of the workforce speaks Spanish at home. That is not a staff member translating. It is the attorney.
Zobel Legal Group is a small firm by design. Free consultation, contingency fee, and virtual meetings available so you do not have to drive to Denver.
Frequently Asked Questions
What should I not say to a personal injury lawyer?
Nothing. Tell your own attorney everything, including the parts that make you look bad. What you say to your lawyer is confidential, and surprises later are what damage cases. The conversation to be careful about is the one with the other driver’s insurance company.
How much do personal injury lawyers charge?
Zobel Legal Group works on contingency. There is no fee for the consultation and no fee unless we recover money for you. The percentage is set out in writing before you sign anything.
Is it worth filing a claim for a minor injury?
Sometimes yes, sometimes no, and it is worth one free phone call to find out. Injuries that seem minor in week one occasionally turn out not to be, and once you sign a release you cannot reopen the claim.
How long does a personal injury case take?
It depends on how long your medical treatment lasts and whether the insurer disputes fault. Straightforward claims can resolve in months. Cases involving serious injuries or contested liability take longer, sometimes well over a year.
Do I have to come back to Colorado?
Usually not for most of the process. Much of it is handled by phone, email, and video. If your case goes to trial, that changes, and we would talk about it well in advance.
The other driver was cited by police. Does that settle it?
It helps, but no. A traffic citation is a separate proceeding from your injury claim. The insurance company can still dispute how much your injuries are worth even when fault is clear.
